Opioid Fraud And New Congressional Act
We just added some new resources to our page about those needing legal representation regarding fraud pertaining to opioid manufacturing, pharmacists and other distribution. In 2018 Congress passed the Substance Use Disorder Prevention that Promotes Opioid Recovery and Treatment for Patients and Communities (SUPPORT) Act (click here for the PDF of that Act), and some of the legal issues deal with the risks similar to the Anti-Kickback Statute, among others.
Of interest is that a link (PDF) to a memo outlines 8 exceptions to the general prohibition including topics such as:
- properly disclosed and appropriate price reductions
- payments to properly-documented employees
- waivers/discounts of any co-insurance/co-payment by a healthcare benefit program if certain conditions are met
- the rest of the exceptions
